This Privacy Policy explains how Curved Physicians Inc., a California professional corporation, and its affiliated entities (collectively, the “Companies,” “we” or “us“) collect and use personal information, as more particularly described below (“Personal Information”). It applies to our websites or other services that directly link to this Privacy Policy (collectively, “Sites”). This notice does not apply to our employees or contractors.

BY USING THE SITES OR OTHERWISE PROVIDING US WITH YOUR PERSONAL INFORMATION, YOU ARE AGREEING TO THE PROCESSING OF INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY. PLEASE READ IT CAREFULLY.
Categories of Personal Information
Personal Information includes any information that may be used to identify an individual. We collect, and in the preceding twelve (12) months have collected, the following categories of Personal Information:
- Contact Information: your first and last name, email address, a home, postal or other physical address, and phone number
- Demographic Information: age, gender, occupation, industry, personal interests, education information, and salary information
- Location Information: your rough geo-location based upon your device’s IP address
- Health Information: information you provide to us and information we generate about you related to your physical, mental or other health conditions
- Financial Information: tax identification number, financial or bank account information, and tax-related information
- Commercial Information: records of products or services purchased, obtained, or considered
- Internet or Electronic Usage Data: data related to network and website interaction history, IP address, website cookie information, interaction with advertisements, and browsing time
- Log Data: your device identifier, user settings, browser type, operating system, the web page that you were visiting before accessing our Sites, the pages or features of our Sites to which you browsed to give us an idea of which part of our Sites you visit and how long you spend there
- Audio/Visual Data: audio, electronic, photographic, visual or similar data including videos, photographs, or audio recordings
- Sensitive Personal Information: limited government issued identification numbers (e.g., social security, driver’s license, state identification card, passport number) and account log-in information (e.g., username and password to online account with us)
- Inferences: information from the categories of Personal Information described above in order to create a profile about you, to reflect your preferences, characters, behavior, and attitude
- Other Identifying Information: other information that may identify you or may be reasonably used with other publicly available information to identify you
Purposes for Collecting Personal Information
We use, and in the preceding twelve (12) months have used, Personal Information for the following categories of use:
- Transactional Purposes: We may use your contact information, other identifying information, health information, financial information, commercial information, and internet or electronic usage data, to provide you with and communicate about services, to provide you with and manage your access to the Sites or to communicate with you about the Sites.
- Analytical Purposes: We may use your other identifying information, health information, financial information, commercial information, internet or electronic usage data, log data, demographic information, and location information to analyze preferences, trends and statistics.
- Provide and Improve Our Services: We may use your information to provide, develop, maintain, operate, improve, enhance, administer, protect, and troubleshoot our services and your experience with them, including contact information, demographic information, health information, financial information, commercial information, internet or electronic usage data, location information, log data, audio/visual data, and other identifying information.
- Operate Our Business: We may use contact information, health information, financial information, and commercial information to operate our business, including for billing, accounting, and improving our internal operations.
- Marketing and Promotional Purposes: We may use your contact information, health information, financial information, commercial information, internet or electronic usage data, other identifying information, demographic information, location information, and log data to:
- Inform you of our new products, services and offers; and
- Provide you with other information from and about our Company, including personalized marketing communications.
- Client Feedback and Testimonials: We may use feedback you provide, such as satisfaction survey responses, reviews, or testimonials, to improve our services and for internal training purposes. We will never disclose your name or any identifying details without your explicit permission.
- Maintenance and Improvement of the Sites: We may use other identifying information and log data to administer the Sites and we analyze (and may engage third parties to analyze) other identifying information, log data, internet or electronic usage data, demographic information, and location information to improve, customize and enhance the Sites by expanding their features and functionality and tailoring them to our users’ needs and preferences.
- Security and Fraud Prevention: We may se your contact information, other identifying information, location information, internet or electronic usage data, and log data to protect the Sites, our Companies, and others and to prevent fraud, theft, and misconduct.
- Legal: We may use contact information, other identifying information, demographic information, health information, financial information, commercial information, internet or electronic usage data, location information, and log data to comply with our legal obligations, including reporting requirements, and defend ourselves in legal proceedings, and protect our company and our property, employees, and others through legal proceedings.
- Corporate Transactions: If the Companies are merged, acquired, or sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer contact information, health information, financial information, commercial information, personal characteristics or traits, health information, geolocation data, internet or electronic usage data, audio/visual data, log data, inferences, education information, and sensitive information in connection with such transaction.
- Other Purposes: We may use contact information, other identifying information, demographic information, health information, financial information, commercial information, internet or electronic usage data, location information, and log data for other reasons we may describe to you.
Sources of Personal Information
We collect, and in the preceding twelve (12) months have collected, Personal Information from the following sources:
- Directly From You: We collect contact, other identifying information, health information, financial information, commercial information, internet or electronic usage data, and demographic information directly from you. This includes when you register for an account or when you submit your Personal Information to us on the Sites.
- From Third Parties: We collect your contact information, other identifying information, demographic information, log data, health information, financial information, commercial information, internet or electronic usage data, and location information, from third parties, including our vendors, clients, recruiters, and service providers. We may collect your Personal Information from Facebook or other social media sites, in accordance with their terms of use and privacy policy.
- Passively From You: We may collect contact information, commercial information, location information, log data, and internet or other electronic activity passively using tools like browser cookies. This activity is further described in the Cookies section below.
- When You Visit Our Locations: When you visit our offices or locations, we may collect contact information and audio/visual data.
- Social Media Platforms: Depending on the information you choose to share and your privacy settings, we may collect contact information, audio/visual data, commercial information, internet or electronic usage data, location data, and log data. Based on the way you have set your privacy settings on your social media accounts, most social media platforms, like Facebook, analyze data about how you interact with our Sites and combine it with information on other users to provide us information about you. In addition, we may receive information about you if other users interact with us on social media and information about you is visible to us, for example the fact that you are “friends” or other public-facing profile information.
Disclosures of Personal Information
We disclose, and in the preceding twelve (12) months have disclosed, Personal Information to third parties in the following circumstances:
- Services Providers: We may engage third-party services providers to work with us to administer and provide services. These third-party services providers have access to your Personal Information only for the purpose of performing services on our behalf and are expressly obligated not to disclose or use your Personal Information for any other purpose. In the past twelve (12) months, we have disclosed contact information, other identifying information, log data, demographic data, location data, health information, financial information, commercial information, internet or electronic usage data, and audio/visual data to our service providers.
- Affiliates: We may disclose Personal Information with businesses controlling, controlled by, or under common control with our Company. In the past 12 months, we have disclosed contact information, other identifying information, log data, demographic data, location data, health information, financial information, commercial information, internet or electronic usage data, and audio/visual data to our affiliates.
- Analytics and Advertising Partners: We may share Personal Information with third party analytics or advertising partners, who provide analytics, marketing, and advertising services to us. In the past twelve (12) months, we have disclosed other identifying information, log data, demographic data, location data, internet or electronic usage data, to our analytics and advertising partners.
- Marketing/Analytics/Advertising Partners: We may share Personal Information with third party marketing, analytics, or advertising partners, including social media platforms and networks, who provide analytics or marketing and advertising services to us. In the past twelve (12) months, we have disclosed contact information, demographic information, commercial information, internet or electronic usage data, location information, log data, audio/visual data, and other identifying information to marketing, analytics, or advertising partners.
- Government Entities: We share information with regulatory and government entities including government, administrative, law enforcement and regulatory agencies; tax authorities; and other public agencies or authorities if we think we should in order to comply with any applicable law, regulation, legal process or other legal obligation. This includes cooperating with law enforcement when we think it is appropriate, obtaining legal remedies or limiting our damages, and to enforcing or protecting our contracts, legal rights or the rights of others, including by responding to claims asserted against us.
- In Connection with Business Transactions: We may disclose your personal information in the event we sell or transfer all or a portion of our business or assets.
- For Our Protection and the Protection of Others: We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to enforce our Terms of Service, (ii) to respond to claims, legal process (including subpoenas); (iii) to protect our property, rights and safety and the property, rights and safety of a third party, our users, or the public in general; (iv) to stop any activity that we consider illegal, unethical or legally actionable activity; and (v) as required in accordance with related applicable local, state or federal laws. We have not disclosed Personal Information in connection with the foregoing in the past twelve (12) months.
- Other Reasons: We may disclose Personal Information for other reasons we may describe to you at the time of collection if you consent to the disclosure or direct us to disclose your information.
We Combine Information
We combine information we obtain from different sources with publicly available information, including to create inferences about you. For example, we may combine information that we have collected offline with information we collect online. We combine information that we have collected across other third party sites. We combine information across devices, such as computers and mobile devices. We may also combine information we get from a third party with information we already have.
How Long We Keep Personal Information
We will retain and use your information for as long as we need it to provide you services, or as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Where we process Personal Information for marketing purposes, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing so that we can respect your request in future. We use the following criteria to determine retention periods:
- how long the information is needed to provide our services and operate our business;
- whether there are contractual or legal obligations that exist that require us to retain the information for period of time;
- whether any law, statute, or regulation allows for a specific retention period;
- whether an individual has agreed to a longer retention period;
- whether the data is considered to be sensitive data; and
- what the expectation for retention was at the time the data was provided to us.
Cookies and Tracking Technology
We want you to be aware that certain online tools exist to help us serve and recognize you when you visit our website. We receive and store certain types of information when you visit our website. When you access the website, we (including third-party analytics and advertising companies we work with) may place small data files on your computer or other device. Some third-party services providers that we engage (including third-party advertisers) may also place their own cookies on your hard drive. These service providers may use certain information (e.g. click stream information, web browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to our website and other websites in order to provide advertisements about services likely to be of interest to you. These service providers typically use a cookie to collect this information. Your Choices
- Access: To the extent permitted by applicable law, you can request access to and copies of the Personal Information we process about you by contacting us in writing at hello@curvedbody.comWe may not be required to disclose some or all of your Personal Information.
- Correction: You can request correction of certain account information, such as email address or phone number associated with your account, by contacting us in writing at the addresses below. We are not required to correct information that is accurate or outside of our control.
- Opt-Out: We may periodically send you our newsletter and e-mails that directly promote our Sites. When you receive such promotional communications from us, you will have the opportunity to “opt-out” (either through your account or by following the unsubscribe instructions provided in the e-mail you receive). We do need to send you certain communications regarding the Sites and services you requested or initiated, and you will not be able to opt out of those communications – e.g., communications regarding updates to this Privacy Policy.
Data Security
We follow industry standards to protect the Personal Information submitted to us and have implemented reasonable technical, organization, administrative and physical measures to protect Personal Information. However, no method of transmission over the Internet, or method of electronic storage, is one hundred percent (100%) secure. Therefore, we cannot guarantee its absolute security and encourage you to use websites and share information with caution.
If we become aware of a breach that affects the security of your Personal Information, we may provide you with notice as required by applicable law. To the extent permitted by applicable law, we may provide any such notice that we must provide to you under applicable law at your account’s email address. By using the services, you agree to accept notice electronically.
Responding to Do Not Track Signals
Our website does not have the capability to respond to “Do Not Track” signals received from various web browsers.
Children and Privacy
We do not knowingly collect or store any Personal Information from anyone under the age of sixteen (16). If we become aware that we have collected or stored Personal Information from an individual under age sixteen (16), we will remove his or her Personal Information from our files. If you are a parent or guardian and believe we may have inadvertently collected Personal Information from your child, please notify us immediately by sending an email to hello@curvedbody.com.
Third Party Sites
The Sites contain links to other sites that are owned or operated by third parties. We are not responsible for the content, privacy, or security practices of any third parties. To protect your information, we encourage you to learn about the privacy policies of those third parties.
International Transfer
Your information is stored by the Companies on controlled servers with limited access and may be stored and processed in the United States or any other country where the Companies or agents are located. If you’re located outside the United States and choose to provide your Personal Information to us, we may transfer your Personal Information to the United States and process it there. Those who choose to access and use the Sites from outside the United States do so on their own initiative, at their own risk, and are responsible for compliance with applicable laws.
California Consumer Privacy Rights
California residents have certain privacy rights under the California Consumer Privacy Act, as applicable. This section describes those rights and how you can exercise them with our Company. To exercise any of these rights, please send an email to hello@curvedbody.com or write to us at the address below. You must use “CCPA Rights Request” in the subject line of your email. You must provide us with your first name, last name, email address, and phone number. To verify your identity, we will match that information to the information we have on our systems. To designate an authorized agent to act on your behalf you must send a signed, written authorization containing your first name, last name, email address, and phone number to: hello@curvedbody.com.
Sale or Sharing of Personal Information
In the preceding twelve (12) months, we have “sold” or “shared” (as those terms are defined in the CCPA) other contact information, identifying information, demographic, log data, and location data to analytics/advertising partners. We do not knowingly sell or share the Personal Information of minors under the age of sixteen (16).
Your Rights Under the CCPA. Subject to certain exceptions and limitations, the CCPA affords California consumers the following rights:
- You have the right to request that we tell you (i) what Personal Information we have collected about you, (ii) the sources of that information, (iii) the business or commercial purposes for collecting, selling or sharing the Personal Information; and (iv) the categories of third-parties to whom we have disclosed Personal Information.
- You have the right to request that we provide you with a copy of your Personal Information.
- You have the right to request that we delete Personal Information that we have collected from you. We may not delete all of your Personal Information if one of the exceptions to the CCPA applies.
- You have the right to opt-out of the sale of your Personal Information or sharing of your Personal Information for cross-contextual behavioral advertising and can opt-out here.
- You have the right to correct inaccurate Personal Information that we hold about you.
- You have the right to not be discriminated against for exercising any of your CCPA rights. We will not discriminate against you, deny you services, charge you a different price, or provide you with a lesser quality of services if you exercise any of your CCPA rights.
Right to Opt-Out of Sale of Information
You have a right to opt-out of the sale of your personal information. The CCPA defines a “sale” as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration. While we do not sell personal information for monetary value, we may disclose personal information to third parties, such as catalog cooperatives, in such a way that may be considered a “sale” of personal information under the CCPA. You must use “California Opt-Out” in the subject line of your email.
In your request, you must provide us with your name, email address and mailing address. Failure to provide all of the foregoing information will prevent us from processing your request. Further, in order to verify your identity, we will match that information to the information we have in our systems. Additionally, some requests may be subject to additional identity verification procedure. In order to designate an authorized agent to act on your behalf, you must send a signed, written authorization to us at hello@curvedbody.com.
We do not sell personal information of minors who we know are under sixteen (16) years of age.
Requests to Delete Your User Data
You have the right to request that we delete Personal Information that we have collected from you. We may not delete all of your Personal Information if one of the exceptions to State laws applies.
To exercise this right, please send an email to hello@curvedbody.com or write to us at the address below. You must use “User Data Deletion Request” in the subject line of your email. You must provide us with your first name, last name, email address, and phone number. To verify your identity, we will match that information to the information we have on our systems. To designate an authorized agent to act on your behalf you must send a signed, written authorization containing your first name, last name, email address, and phone number to: hello@curvedbody.com.
Notice for California Users and Residents
Under California Civil Code Section 1789.3, California users are entitled to the following specific consumer rights notice: If you have a question or complaint regarding the Sites please send an email to hello@curvedbody.com. California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd, Sacramento, CA 95834.
California residents are entitled to ask for a notice identifying the categories of Personal Information which we share with certain third parties for direct marketing purposes under certain circumstances and providing contact information for such third parties. If you are a California resident and would like a copy of this notice, please submit a written request to the address at the end of this notice.
Shine the Light
California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes. If you are a California resident and would like to make such a request, please contact us at hello@curvedbody.com.
Changes to this Privacy Policy
We may amend this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we will notify you of those changes by posting on the Sites and we will update the “last updated date” above to indicate when those changes became effective.
